Please read these terms and conditions carefully before making any donations. You should understand that by making a project donation, you agree to be bound by these terms and conditions.

1. Our Business Policy
1.1 Al-Mustafa USA offers projects and appeals that users can donate on almustafausa.org and its e-commerce business services are available exclusively to its end users, i.e. the “Donors”.
1.2 “Donors” shall mean any individual who is acting for purposes on helping making financial donations to one or more of our humanitarian projects to help people who are less fortunate, disabled, orphan or suffering from civil war or global disaster etc. If you are not a Donor, please do not make a donation on almustafausa.org.
1.3 almustafausa.org reserves the right not to process orders received from users who are not “Donors” and any other order which does not comply with Al-Mustafa USA ® Ltd business policy.
1.4 These General Terms and Conditions of Sale (together with the documents referred to herein) regulate the offer, transmission and acceptance of donation orders relating to projects or appeals on almustafausa.org between the users of almustafausa.org and Al-Mustafa USA ®.
1.5 The General Terms and Conditions of Sale do not regulate the supply of services or the sale of projects or appeals performed by third parties that are on almustafausa.org through links, banners or other hypertext links. Under no circumstances shall Al-Mustafa USA® Ltd be deemed liable for the supply of services provided by third parties or for the execution of e-commerce transactions between users of almustafausa.org and third parties.
2. How to Execute a Contract with Al-Mustafa USA ® Ltd
2.1 To place an order for the purchase of one or more products on almustafausa.org, you must add the products to the shopping basket then go to checkout to complete the order by following the relevant instructions.
2.2 The order form contains a link to these General Terms and Conditions of Sale, and also contains information on the main characteristics of each project donation ordered and the relevant donation price, the type of payment that you may use in order to purchase each project donation and references to the terms and conditions for cancelling project or appeal donations.
2.3 An order shall be deemed submitted when Al-Mustafa USA® Ltd receives your project order form electronically and the order information has been verified as correct.
2.4 Before submitting your order form for the purchase of project donations, you will be asked to carefully read the General Terms and Conditions of Sale, to print a copy using the print option and to save or reproduce a copy thereof for your own personal use.

If the projects or appeals displayed on almustafausa.org are no longer available at the time of your last access or once Al-Mustafa USA® Ltd has received your order form, Al-Mustafa Welfare USA ® Ltd shall inform you of the unavailability of the projects or appeals within thirty (30) days from the day after Al-Mustafa USA ® Ltd has received your order.
If the order form has been sent and the price has been paid for projects or appeals that are no longer available, Al-Mustafa USA® will refund the amount paid for those donated items.
2.10 By submitting an order form to Al-Mustafa USA ® , you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale in your contract with Al-Mustafa USA® Ltd. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on almustafausa.org.
2.11 By submitting an order form, you agree and accept these General Terms and Conditions of Sale as well as further conditions contained on almustafausa.org, through links, including the General Terms and Conditions of Use and Cookies & Privacy Policy.

3. Guarantees and Project or Appeals Price Indication
3.1 On almustafausa.org, we offer humanitarian projects and appeals products for donation purposes. These products are carried out by Al-Mustafa USA ® Ltd directly as well as its sister company in Pakistan, Al-Mustafa Welfare Society® and

4. Payments
4.1 Payment of the project or appeals prices must be made by using one of the procedures indicated on the order form.
4.2 In case of payment by credit/debit card, all details (for example, card number or expiration date) will be sent by encrypted protocol to PayPal. Such credit card details are not stored almustafausa.org. If we need to issue a refund we will do it directly on PayPal where your payment amount will be shown but none of your credit card details are accessible. In the case of returns, we adhere to in compliance with the exercise of your return right or for reporting cases of fraud to the police. 6. Donation Rights and the Cooling-Off Period
6.1 If you are a Donor, you may cancel your contract with Al-Mustafa USA® in relation to project or appeals donations purchased from almustafausa.org, without any penalty and without specifying the reason, by notifying Al-Mustafa USA® Ltd in writing within seven (7) working days, beginning with the day after you completed the donation. 7. Refund Procedures
7.0 Generally, a donation to Al Mustafa USA is, like all charitable donations, not refundable. Legally, a charitable contribution is a gift, and, like any gift, is an irrevocable transfer of a donor’s entire interest in the donated cash or property.
Al Mustafa USA may consider (in its absolute discretion) a refund if the donation was made accidentally or in some other extremely unusual circumstance. In such cases, Al Mustafa USA must receive a request within 72 hours of the donation.

Al Mustafa USA cannot issue a refund after the donated funds have been granted to a project. On the rare occasion that a donation is refunded, any associated tax receipt is no longer valid.
7.1 If the recipient of the project or appeal donation indicated in the order form is different from the individual who made the payment for such a donation, the amount paid shall be refunded by Al-Mustafa USA® to the individual who made the payment.
7.2 We will usually refund any money received from you using the same method originally used by you to pay for the purchase.
7.3 Al-Mustafa USA® will refund the price of the

b) payment by PayPal: refunds will be credited to your PayPal account and will be visible immediately. The actual reimbursement to the credit card associated with your PayPal account depends on the company that issued the card;

9.1 These General Terms and Conditions of Sale are governed by United Kingdom law and in particular by Privacy and Electronic Communications (EC Directive) (Amendment) Regulations 2011 (UK Regulations) on certain aspects related to e-commerce.

We carry out appropriate checks on all potential or current partners to reduce the risk of fund mismanagement, ensure the partner is capable of delivering the specific project or projects and assure the funds provided are protected and used in the correct way for the intended purpose. Checks may include some or all of the following:
- Whether the organisation is genuine, reliable and competent to carry out the activity being funded
- Whether the organisation is culturally suitable for The Charity to work with and fund and whether there is a strategic ‘mission fit’ or match between the partnering organisation’s aims and The Charity’s purposes and interests
- Steps to monitor, check and confirm that the funds granted have been properly used in line with intended purposes
- Steps to check any exposure to risks such as fraud, financial crime, extremism or terrorism have been identified and managed. We ensure that directors, trustees, officers, employees and volunteers are not, and nor do they appear on, any list of individuals or organisations identified as associated with terrorism or designated by the United States Government Office of Foreign Assets Control (OFAC), the United Nations Security Council’s Sanctions Committee (UNSCSC), the European Union, the United Kingdom.

As part of the process, once all checks have been made, we will review all data available and make an informed decision to proceed with a partnership or a specific project through the partner, with assessment being based on all evidence to hand. In some instances, additional documentation or assurances may be requested before a final decision is made, including possible due diligence checks on downstream delivery partners, if it is believed these steps reduce risk and increase assurance.
12. Safeguarding Children Policy
12.1 This policy applies to all staff, including senior managers and the board of trustees, paid staff, volunteers and sessional workers, agency staff, students or anyone working on behalf of Al Mustafa USA
